ACT,1952.
The Regional P.F.Commissioner, has power to initiate
proceeding u/s.7A of The E.P.F. & M.P.Act,1952. There
are many grounds on which the authority may issue
orders to initiate the proceedings u/s.7A such as
complaint of union , non payments or
Less payments of contributions, coverage dispute,
non compliance, instructions of Head Quarters etc..
The powers are lying with the Asst. P.F.Commissioner
to summon the company with records of the company
which he deems fit for the proceedings. During the
proceedings A.P.F.C. may call for any person he deems
fit for the proceedings even the representative of
the complainant union.
The order u/s.7A is binding to the company & the
directors/partners/proprietor even in their personal
capacity.

APPEARANCE IN PROCEEDING U/S.45A
OR 85 OF THE E.S.I. ACT,1948.
The authority may initiate the legal proceedings
for the coverage dispute, clubbing dispute,
contribution on omitted wages,damages & interest
payment etc.. We A.Shukla & Co. regularly appear
on behalf of the companies. The authority can ask to
pay contribution of omitted wages but what is omitted
wages is a question of interpretation of the definition
of wages as defined under the Act. Therefore the interpretation
of omitted wages requires expertise which we, A.Shukla & Co.
has.
After the order of the authority, the employer
has to obey the order or he may challenge
the order in the E.I. Court.
We,
A.Shukla & Co. appear in the E.I. Court on behalf
of the company. We also undertake the liasion
work with the E.S.I. Dept..We use to remain present
at the time of Inspection of the authority & argue
on behalf of the company. We can also provide
guidelines to the company at the time of
accident and also for the benefits under the Act.
APPEARANCE IN THE CONCILLLIATION MATTERS
BEFORE ASST. LABOUR COMMISSIONER
Asst. Labour Commissioner may summon the
company when
any complaint by employee or representative
union is received for the conciliations.
The same complaint may be for reinstatement under Sec.10(1)(c)
of The Industrial Disputes Act,1947. In case of demand
or dispute, the employer can also be summons. We, A.Shukla & Co.
use to appear on behalf of the company for
the representation.
APPEARANCE BEFORE THE CONTROLLING AUTHORITY UNDER
THE PAYMENT OF GRATUITY ACT,1972
The controlling authority
under The Payment of Gratuity Act,1972, may summon
the company to represent the facts of the case on
receipt of complaint from any employee. The order
of the controlling authority is binding to the company
as well as the employee. We, A.Shukla & Co.
use to represent the case on behalf of the
company.

The Regional Labour Commissioner(Central)
has powers to examine the records
of certain class of industries which
fall within their purview. The officers from their
office may inspect the records of the company under
The Minimum Wages Act, The Payment of Gratuity Act,
The Contract Labour(R&A) Act
etc.. The R.L.C. has powers to initiate
legal actions against the company.
